Which asylum documents need certified English translation?

Every foreign-language document submitted to USCIS with Form I-589 should have a full certified English translation. This can include identity records, written declarations, police or court documents, medical records, membership evidence, and news exhibits. The translation must cover all submitted text and include a signed certification of completeness, accuracy, and translator competence.

What does this guide cover for a Form I-589 filing?

This guide covers translation procedure only. It explains how to prepare foreign-language records that a person has already selected for submission with Form I-589 or in a related USCIS asylum process. It does not advise whether someone qualifies for asylum, which facts belong in an application, how to describe past events, whether a filing deadline applies, or how an officer may evaluate evidence.

Asylum law and procedure are fact-specific. A qualified immigration attorney or a representative accredited by the US Department of Justice can advise on eligibility, deadlines, filing posture, evidence strategy, interview preparation, and responses to government requests. Translators should stay within their language role. They reproduce the submitted record in English and certify their work without changing, strengthening, or interpreting the underlying account.

What USCIS translation rule applies to asylum evidence?

The regulatory foundation is 8 CFR 103.2(b)(3). A document containing foreign-language text that is submitted to USCIS must be accompanied by a full English translation. The translator must certify that the translation is complete and accurate and that the translator is competent to translate from the source language into English. The certification should identify the translator and be signed and dated.

Full translation means the complete submitted record, including printed text, handwriting, stamps, seals, headers, footers, page numbers, annotations, and relevant reverse-side text. An English summary of a long declaration or police report does not satisfy the full-translation requirement for the foreign document being submitted. If only a selected complete article or record is submitted, keep enough source information to identify it and translate all pages in that selected item.

Notarization is separate from certification and is not part of the federal rule in 8 CFR 103.2(b)(3). An apostille also serves a different purpose. Do not add either service unless a specific receiving instruction calls for it. How should identity documents be translated for I-589?

Identity records may include a passport, birth certificate, national identity card, family book, marriage record, or another civil document selected for the filing. Translate names, dates and places of birth, parent information, nationality or citizenship language as stated, document numbers, issue and expiration dates, issuing authority, registry details, stamps, and handwritten observations. Scan both sides when the reverse carries text.

Transliteration should be consistent with the passport or principal identity document used in the filing. The source may contain patronymics, former names, aliases, or historical spellings. Preserve them. A translator can note a linguistic variant but should not merge two names or declare that two records concern the same person. Any evidentiary explanation connecting identities belongs outside the certified translation and should be reviewed with the applicant's legal representative.

How are declarations and witness letters translated?

A declaration or witness letter should be translated in full, preserving the author's wording, paragraph order, dates, names, locations, heading, signature notation, and any attached identification or exhibits included in the submitted record. The translator should not rewrite the statement into a more formal narrative, correct factual inconsistencies, remove repetition, or add details that the author did not provide.

If a source sentence is ambiguous, the English should remain faithful to that ambiguity. A translator may request clarification about illegible handwriting or an unclear scan, but cannot interview the author to create a new version inside the translation. Material corrections should be made in the source statement through the process chosen by the applicant and legal representative, then the final source should be translated.

Dates, kinship terms, political or organizational titles, and local administrative terms need careful handling. Some words have no exact English equivalent. A short bracketed note can identify the original term or explain a narrow language point. It should not characterize an organization, infer motive, assess credibility, or state that an event meets a legal standard.

What should police and court record translations preserve?

Police reports, complaints, summonses, judgments, detention documents, and military records may contain sensitive allegations or official findings. Translate the issuing authority, parties, file or case number, date, stated event, cited provision, procedural status, outcome, sentence or disposition when shown, signatures, seals, and attachments. Use neutral language that tracks the source, even when the content is upsetting or the terminology has political significance.

A complaint is not automatically a judgment, and an accusation is not automatically a conviction. The English title and terminology should preserve that distinction. A translator must avoid upgrading a local police note into an arrest warrant or calling an administrative decision a criminal conviction without support in the source. Legal consequences fall outside translation. Before submitting a criminal, detention, military, or court record, consult a qualified immigration attorney or DOJ-accredited representative about disclosure and case-specific implications. The translator can flag an illegible seal or missing page, but cannot advise whether the document helps, harms, or satisfies an asylum claim.

How should medical and psychological records be translated?

A medical translation should retain the patient's identity, facility and clinician, visit or treatment dates, reported history, observations, diagnosis as written, tests, medications, treatment, follow-up, signatures, and stamps on the selected record. Medical abbreviations should be expanded only when their meaning is established by the source context. If an abbreviation remains uncertain, preserve it and use a limited translator note rather than guessing.

Do not ask a translator to edit a clinical opinion or connect it to a legal standard. A certified translation reports what the clinician recorded. Medical records can contain data about other people, contact details, or unrelated history. Discuss evidence selection and any lawful redaction strategy with counsel before translation. The translator should receive the final version intended for submission and translate what remains visible on that version.

How are news articles and public exhibits translated?

Public material can include a newspaper article, government notice, organization statement, social media post, or screenshot. Preserve the publication or account name, headline, author when shown, publication date, URL or visible source reference, captions, relevant interface labels, and complete selected text. A screenshot should include enough context to identify the speaker, platform, date, and surrounding exchange when those elements appear in the source.

How should sensitive asylum files be handled for translation?

Asylum records can contain addresses, identity numbers, medical information, family details, and accounts of violence or detention. Before uploading, confirm that the translation provider uses controlled file access, encrypted transfer, limited retention, and a clear confidentiality policy. Mechanical review is different from legal review. It can catch a missing reverse side, a reversed numeric date, an omitted stamp, or a certification attached to the wrong exhibit. A legal representative should review consistency, disclosure, filing requirements, and the role of each exhibit. Keep those two reviews separate so the translator is not asked to make legal judgments.
