A divorce decree issued abroad has to be understood by the register office, embassy or court that must act on it, and a British or American decree has to be understood by foreign authorities. It is a long document in legal language where every word of the operative part counts. A certified translation serves for remarriage, registration, maintenance or recognition abroad.
Remarriage, recognition, enforcement: the uses
A register office usually asks anyone divorced abroad to show the translated decree before a new marriage, to prove the earlier union ended. The Home Office (UKVI) wants it for a spouse visa when a previous marriage is mentioned, and USCIS requires it for a family petition. The decree absolute, or the final judgment in the US, is the document that matters. Solicitors and family courts use it to settle maintenance, property and child arrangements. Abroad, a translated British decree is used to have a divorce recognised or a maintenance order enforced.
What the translation must contain
The translator reproduces the heading of the court, the case number, the identity of the parties, the grounds and above all the operative part: the dissolution of the marriage, its effective date, custody, contact, maintenance, any financial settlement and name arrangements. The statement that the judgment is final, the certificate of no appeal and the court clerk's signatures are translated too, because they prove the decision can no longer be challenged. Legal terms are rendered with their accepted equivalents, with a bracketed note when a concept does not exist in the destination country's law.
Sending a complete judgment
Send every page, including those that seem purely formal. An office that receives a nine-page judgment with page six missing will send it back. Ask the court for a certified copy, which is more legible than a copy of a copy. If an authority accepts a translation limited to the order itself, as happens for some remarriages, have it confirmed in writing and list the pages chosen in the Additional information field.

Have the judgment apostilled or legalised before translation if the destination country requires it, and check that the decision is final. A judgment still open to appeal will not allow a remarriage or a registration.

How many pages does a divorce decree usually run to?
A divorce decree is considerably longer than a civil status certificate, often running between three and ten pages depending on how complex the proceedings were. The quote is therefore calculated on the actual number of pages you provide rather than a flat fee.
Do you need the original decree, or is a copy enough?
A scanned copy of the complete decree is enough for the translation. The foreign authority recognising the decree, on the other hand, will often ask for a certified true copy of the original, which you'll need to obtain separately from the court.
Does the certificate of non-appeal also need to be translated?
Yes, the certificate of non-appeal (attestation de non-pourvoi) accompanying the decree needs to be translated along with the body of the decree for the file to be complete. Add it to your order — it's treated as an extra page of the same document.
